a. Company: Instrumental Healthcare (Pty) Ltd.
b. Customer: The person or organisation purchasing or using the Company’s products or services.
c. Products: The medical instruments, equipment, and related items offered by the Company.
d. Services: The consultation, maintenance, and other services provided by the Company.
a. All quotations, whether in writing or verbal, are subject to “errors and omissions excepted”. Should an error inadvertently occur in the submission of a quote, the Company reserves the right to correct this error and will not be bound by the original incorrect submission.
b. All orders are subject to acceptance and availability. The Company reserves the right to refuse any order placed by a Customer.
c. Prices for products and services are subject to change without notice. The Company will not be liable for any price changes.
d. Payment must be made in full at the time of ordering so that the order can be processed, unless otherwise agreed in writing by the Company, or unless payment terms have been granted.
e. Payment terms, if granted, are strictly 30 days from statement (unless otherwise agreed in writing).
f. The company reserves the right to charge interest on overdue accounts at 2% per month.
g. All items remain the property of Instrumental Healthcare (Pty) Ltd until fully paid for.
a. The Company will make every effort to deliver products on the agreed dates. However, the Company will not be liable for any delay in delivery caused by circumstances beyond its control.
b. Risk in the products passes to the Customer upon delivery.
c. The Company reserves the right to charge delivery costs, unless the product is collected from the office in Randburg.
a. Returns, if permitted, will only be accepted within 7 days of delivery and in original packaging.
b. A handling fee of 15% may be levied on returns, if the returns have been permitted. The obligation is on the customer to demonstrate that authorisation for a return has been granted.
c. To initiate a return, the Customer must contact the Company’s customer service department to obtain authorisation.
d. The Customer is responsible for the cost of return shipping.
a. The Company warrants that the products will be free from defects in material and workmanship upon delivery.
b. The Company’s liability under this warranty is limited to the repair or replacement of the defective product, at the Company’s discretion.
c. The Company will not be liable for any indirect, incidental, or consequential damages arising from the use of its products or services, either due to product failure or user error.
a. These terms and conditions are governed by and construed in accordance with the laws of The Republic of South Africa, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of The Republic of South Africa.
a. The Company reserves the right to amend these terms and conditions at any time. Any changes will be posted on the Company’s website and will take effect immediately upon posting.
